What Is an Institutional Abuse Claim?

An institutional abuse claim is a legal claim arising from abuse, neglect, or mistreatment connected to an organisation or institution that failed to properly protect a child or vulnerable person.

These claims may involve allegations that:

Institutional abuse claims can involve both historical abuse and more recent abuse.

Abuse in Care Settings

Claims involving:

Physical Abuse Claims

Including excessive punishment, assaults, or mistreatment by staff or carers.

Psychological and Emotional Abuse

Including prolonged mistreatment, intimidation, coercion, humiliation, or neglect.

Historical Abuse Claims in Queensland

Many survivors do not speak about abuse until years later.

Queensland law recognises that historical abuse may not be disclosed when it happens and has amended legislation to allow historical child abuse claims to be brought long after the abuse occurred. In many child abuse matters, limitation periods have been removed for personal injury claims arising from child sexual abuse. The Queensland Government states that time limits no longer apply to actions for damages arising from child abuse in many circumstances. (justice.qld.gov.au)

If abuse occurred years ago, you may still have options available.

NRS v Civil Claims section

The National Redress Scheme was established in response to the Royal Commission into Institutional Responses to Child Sexual Abuse. It provides redress payments (up to $150,000), access to counselling, and direct personal responses from participating institutions. The NRS scheme is a reparation scheme which does not involve any court hearing or pre-court processes. It is a paper-based scheme that commenced in 2017 and will end on 30 June 2027.

Many victims of child sexual abuse have already made their NRS claim, but if you have not, you must lodge your claim before 30 June 2027 or you will miss out. We can help with information, advice and even prepare your application if you want us to.

National Redress Scheme vs Civil Compensation Claims

Some survivors may be eligible to apply to the National Redress Scheme, while others may wish to pursue a separate civil compensation claim.

The National Redress Scheme was established in response to the Royal Commission into Institutional Responses to Child Sexual Abuse. It provides redress payments, counselling access, and direct personal responses from participating institutions. (nationalredress.gov.au)

A civil claim may involve:

Each pathway has different implications. It is important to obtain legal advice before making decisions that may affect your rights.

Common Impacts of Institutional Abuse

Institutional abuse can have lifelong consequences.

Survivors may experience:

Every person’s experience is different. There is no “right” way to respond to trauma.

What If There Is No Police Report or Conviction?

Many survivors worry they cannot bring a claim because:

A criminal conviction is not always required for a civil institutional abuse claim.

Frequently Asked Questions About Institutional Abuse Claims

Possibly. Queensland has removed limitation periods for many child sexual abuse claims.

There may still be legal pathways available depending on the circumstances and successor entities involved.

Not necessarily. Civil compensation claims and National Redress applications can sometimes proceed without a criminal prosecution.

We treat these matters with strict confidentiality and sensitivity.

That is completely okay. Many people first seek advice simply to understand their options.

As Principal Lawyer, I have extensive experience assisting clients through complex TPD claims and personal injury matters. Over the years, I have worked closely with people facing serious illness, injury and financial uncertainty, helping them navigate claims processes that can often feel overwhelming and stressful.

I have a particular focus on Total and Permanent Disability (TPD) claims and understand the significant impact these situations can have on individuals and their families. My role is to help take that pressure off clients and guide them through the process with clear advice and strong representation.

I believe experience is critical when handling TPD matters, particularly when claims involve complex medical histories, pre-existing conditions or declined claims. I am passionate about helping clients understand their rights and ensuring they feel supported and informed throughout every stage of their matter.
