We are expert TPD lawyers who act for people like you every day against some of the biggest insurers in the country. We can assist you wherever you are in Australia.
What does TPD mean?
Total and Permanent Disability. TPD is insurance which usually pays a lump sum benefit when an injury or illness stops you from working, and then stops you returning to the kind of work you have done before. The lump sum benefit is usually calculated at the date you stopped work.
If the TPD insurance is through a Superannuation Fund, once you have a successful claim it will be included in your Superannuation account balance.
Do I have TPD insurance?
Most people have TPD insurance in their Superannuation fund, although some people take out TPD insurance through a financial adviser or insurance broker. If you aren’t sure, we can investigate your insurance for you!
So what is a TPD claim?
To claim your TPD insurance you don’t have to be bed ridden or in a wheelchair!
You don’t have to be unable to perform any work, just suitable work for your based on your education, training, and experience into the future. Some TPD policies allow the insurer to consider reasonable retraining, and for those policies you also have to show you can’t do the work that retraining would prepare you for. For example, if you could retrain as a traffic controller, you must show you couldn’t perform the traffic control work.
Each policy is different in what is required with some TPD definitions being more difficult to meet, which is why it is important to seek help early.
Would my condition qualify for a TPD claim?
Some policies may exclude certain conditions or if you become TPD due to certain situations, although this does not often happen.
In short, either physical or psychiatric injuries can qualify you for a TPD benefit. Unlike personal injury claims, you can include all conditions (physical or psychiatric) whether or not they were caused in the workplace or a motor vehicle accident, or even where you’ve had the condition all your life and it has just worn you down enough to stop work.
We have successfully claimed TPD benefits for deserving clients with the following conditions:
- Lower back, or neck injuries,
