Time Limits for WorkCover Claims in Queensland

A statutory claim must be lodged within 6 months of the date of injury to obtain statutory entitlements. If you miss out on making a statutory claim within this 6 month period, you may be able to make an ‘Out of Time’ claim for Common law damages but statutory benefit such as weekly benefits and treatment expenses will not be paid if you lodge your claim after the 6 moths time frame.

What is the workers’ compensation claims process

Workcover in Queensland is divided into two sections: the statutory division and the common law division.

When you are injured and make a claim through your employer or directly to WorkCover you claim is handled by the statutory division who organise your treatment, rehabilitation and are responsible in most cases for paying your wages if you need time off work as a result of the injury.

Once a statutory claim is accepted, 3 benefits flow to an injured worker:

The statutory claim continues until a medical officer commissioned by WorkCover determines that your injury is stable and stationary: that is, all reasonable treatment has been undertaken, you have reached maximum medical improvement.

Once you have been assessed for permanent impairment*, WorkCover will provide you with a Notice of Assessment in which they will make an offer to settle your statutory claim by offering you a lump sum based on your percentage of impairment.

Upon receipt of a Notice of Assessment an injured worker is then entitled to pursue a common law workers’ compensation claim. It is critical at this point in the claim process, that you contact a workers’ compensation to discuss the offer because if the offer is accepted, you will generally disentitle yourself from making a common law claim.

It is important to understand that any offer on a Notice of Assessment has little correlation to the damages you may receive in a common law claim.

However, a common law claim can only be conducted successfully if negligence can be established on the part of the employer.

To commence a common law claim you must serve a Notice of Claim for Damages on Workcover Queensland and your employer. Once a Notice of Claim for Damages has been served, a mandatory pre-court process begins through which several opportunities arise for the settlement of your claim to be negotiated prior to your claim getting anywhere near a court-house.
